REGULATION GOVERNING THE PROVISION OF SERVICES BY ELECTRONIC MEANS OF COMMUNICATION ANYMAG.PL
1. Regulation governing the provision of services by electronic means of communication ANYMAG.PL constitutes formal document describing processes and requirements arising withing website: https://anymag.pl/ according to use of said website and services offered thereby.
2. In this documents following definitions shall apply:
1) Policy privacy – document describing processing of personal data by Service provider within Website and informing about cookies, available to read at any moment on Website;
2) Regulation – Regulation governing the provision of services by electronic means of communication ANYMAG.PL, available to read at any moment on Website;
3) GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC;
4) Website – a website offering Services on https://anymag.pl/;
5) Services – services offered on Website, performed by sending and receiving data through computerized system, according to individual demand of Recipient of services, without simultaneous attendance of the parties and said data is transferred through public network in the meaning covered by Law on Telecommunications Act;
6) Recipient of services – person concluding with Service provider a service agreement, through Website;
7) Service provider - M2 IT SOLUTIONS sp. z o.o., with registered office on Wały Gen. Józefa Dwernickiego 117/121 street, 42-202 Częstochowa, NIP: 9492227569, KRS: 726643.
1. The service agreement is considered as concluded if following actions of Recipient of services are taken on Website:
1.i.1) examination of Regulation and Policy privacy;
1.i.2) opening of an account in customer’s panel;
1.i.3) choice of Services;
1.i.4) payment for Services (in situation when long-term Services are chosen, paid in instalments, the service agreement is concluded withing payment of the first instalment).
2. After payment confirmation receipt, Service provider commences to perform Services, staying in line with Recipient of services choice. In case of choosing by Recipient of services payment by bank transfer or by credit card, Service provider will commence with Services performance within the day of payment receipt on his bank account.
3. Service provider reserves the right to grant periodical, free of charge right to use functionalities offered on Website. Free access period lapse cause expiration of possibility to use of functionalities, if the parties not conclude the service agreement according to procedure described in item 1.
4. Services are periodical, according to Recipient of services choice and expire within the service agreement period lapse. The parties may terminate the service agreement before end of its period upon bilateral settlement.
1. The payment for Services shall be made according to conditions presented by Service provider on Website.
2. Service provider foresees possibility of commissioning payment services to third parties providing services in this field.
3. The party who provide services in the field of online payment:

4.i.2) with quick payment by pay-by-link, BLIK or credit cards is: Paynow, via Bank S.A., with registered office in Warsaw, at 18 Prosta street, postal code 00-850. More information concerning the operator of payment you may find on: https://www.mbank.pl/o-nas/o-mbanku/ and https://paynow.pl/.
4. Service provider ensures payment by using credit cards:
1) Visa;
2) Visa Electron;
3) Mastercard;
4) MasterCard Electronic;
5) Maestro.
5. In situation when amount paid by Recipient of services by credit card has to be returned, Service provider will return money on bank account assigned to Recipient of services credit card.
1. Service provider performs Services in the scope determined in this Regulation.
2. Whilst using Website Recipient of services declares to obey Regulation.
3. Recipient of services oblige himself to use Website in manner corresponding to its intended use and in the scope of Services ordered, thus declares to not supply any illegal content throughout.
4. Recipient of services shall upload information that are true and actual.
5. Service provider shall not be accountable for damages caused by using of Website, in manner contrary to binding law, customs or Regulation.
6. Service provider shall not be accountable for damages caused by using of Services by unauthorized person who obtained access to Services by way of an unlawful action or omission.
7. Service provider shall not be obliged to check transferred, stored or shared information by Recipient of services.
8. Service provider may remove information and/or suspend Recipient of services access to Website, when information harms Regulation, Privacy policy, or law.
9. Service provider reserves the right to undertake necessary servicing actions of Website, which may cause temporary difficulties or impossibility of using of Services.
10. Service provider may – without notice, temporary withhold or restrict Services and perform servicing action, on specific occasions which impact security and stability of Website.
To use Website the following technical requirements shall be met:
1) electrical and electronic devices with access to Internet, with web browser supporting HTML 5;
2) access to electronic mail (e-mail);
3) having switch on acceptance of Cookies and JavaScript in web browser;
4) online store in Magento, PrestaShop, WooCommerce or other system subject to prior acceptance of Service provider and URL with .xml to wholesale.
1. Using of Website is connected with risk of IT system infection by way of unaccepted software, including this having only aim to harm damages.
2. To avoid described in item 1 endangerment, it is recommended to install antivirus software on electrical and electronic device used by Recipient of services. It is recommended to update antivirus software as soon as the update is available to install.
3. In addition it is recommended to run system firewall on electrical and electronic device.
4. Among possible endangerment to IT system infection the hacking attack shall be calculated. Service provider declares that he uses secure measures making impossible or significantly more difficult to break into IT system.
1. In cases when the agreement on Services is concluded by the consumer in the meaning provided in civil code or by the individual described in article 38a of consumer rights act, those persons have the right to withdraw from agreement within 14 days, after the agreement conclusion.
2. To make use of the withdrawal right, person described in point 1 shall file to Service provider declaration of withdrawal in written form on Service provider address or by e-mail on address indicated on Website. The template of withdrawal declaration or other necessary information concerning rights of persons described in point 1, may be found on: https://prawakonsumenta.uokik.gov.pl/formularze/.
3. In case of withdrawal from agreement, money receipt by Service provider will be returned, including delivery costs (with exception to additional cost occurring from picked other than the most cheapest way of delivery), without undue delay, no later than 14 days from the day when Service provider were informed about withdrawal. Return of money will be served with the same means of payment, that were used priorly by Recipient of services, unless parties decide otherwise.
1. Complaints regarding to Services or Website may be filled by post on Service provider registered office, by telephone or e-mail on following data: +48 34 387 1234; +48 799 729 560; kontakt@anymag.pl.
2. Complaints shall be examined without undue delay, not later than within 14 days, starting from date of its placement. If complaint cannot be examined within 14 days, Service provider shall inform Recipient of services about reasons for delay and indicate examination term.
1. The parties oblige themselves to maintain confidentiality of information acquired according to Services, with following exemptions:
1) information are publicly available or known, if they are not a subject to law or agreement between Service provider and Recipient of services infringement;
2) disclosure is require by law;
3) empowered party grant consent to disclose.
2. Service provider is the data controller of Recipient of services data and processes data among the other to (main purpose) deliver Services i.e. by virtue of article 6 point 1 (b) of GDPR. Information about personal data processing are embodied in Privacy policy, accessible to read on Website. Using Website as well as acceptance of Regulation equals acceptance of Privacy policy. 3. Due to fact that Service provider has commissioned online payment services to: 1) Blue Media S.A. with registered office in Sopot and 2) mBank S.A. with registered office in Warsaw, the personal data of Recipient of services necessary to provide payment services will be shared with above indicated operators. 4. If Services performance requires entrustment to Service provider by Recipient of services personal data processing, whose data controller in the light of GDPR is Recipient of services, conclusion of service agreement equals conclusion of agreement on personal data entrustment, with content described in appendix no 1 to Regulation.
1. Service provider reserves the right to amend Regulation due to important reasons, including amendment dictated by amendment of Website, about which Recipient of services shall be informed and which empower Recipient of services to terminate the service agreement within 14 calendar days, commencing from the date of notice, if the amendment impact the content of the service agreement.
2. In matters not regulated by Regulation the polish law shall apply.
3. In the event of disputes, the parties consider as competent polish common courts, competent over Service provider registered office.
